Welcome to Droodle, operated by Brightmode Pty Ltd (“Droodle,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your use of both our website (www.droodle.com) and the Droodle mobile application (the “App”). By using our website or app, you agree to be bound by these Terms.

If you do not agree with these Terms, do not use the website or the app.

1.1 Access and Content

The Droodle website is provided for general informational and promotional purposes. You may access and use the content for personal, non-commercial purposes.

1.2 Intellectual Property

All content on the website—including text, images, branding, designs, and layout—is owned by Droodle or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, republish, or distribute any materials without prior written permission.

1.3 Analytics and Cookies

We use Google Analytics to collect anonymized data about how visitors interact with our website, including pages visited, time spent, and device type. No personally identifiable information is collected or stored.You can learn more about how Google collects data here:

1.4 Third-Party Links

2.1 App Access and Eligibility

Droodle is intended for children and families. No personal information is required to use the app. Parents or guardians should supervise children during use and are responsible for compliance with these Terms.

2.2 Anonymous Authentication

To track generation limits and manage access, we may assign a random, anonymous device identifier. This ID is not linked to any personal or sensitive information.

2.3 AI Image Generation

Droodle allows users to create drawings and generate AI-enhanced artwork. This involves:

- Processing the user’s drawing with a third-party AI model for real-time transformation
- Temporary uploading of image data for processing
- Automatic deletion of that data immediately after use

No drawing or generated content is stored remotely beyond the active generation session.

2.4 Saved Content
‍
Users may choose to save their original drawings locally on their device through the in-app gallery. This content remains on the user’s device and is never uploaded or shared externally by the app.

2.5 Acceptable Use

You agree not to use the app to:

- Submit offensive, harmful, or inappropriate prompts or drawings
- Attempt to reverse engineer, modify, or disrupt app functionality
- Circumvent limits or access controls

We reserve the right to suspend or terminate app access for violations of these Terms.

2.6 Subscription and Tokens

Droodle offers optional subscription plans that provide users with a monthly allowance of in-app tokens that can be used to generate AI-enhanced images.

These subscriptions are managed through Apple’s in-app purchase system. By subscribing, you agree to Apple’s billing terms, including automatic renewal unless canceled at least 24 hours before the end of the current billing period. All billing, payment, and cancellation must be managed through your Apple ID settings.

Token Policy:

‍Monthly Reset: Tokens included in your subscription plan expire at the end of each billing cycle and do not roll over. Any unused tokens will be forfeited when the new subscription month begins.

‍Platform-Limited: Tokens have no cash value and are only valid within the Droodle app. They cannot be exchanged, sold, transferred, or used outside the platform.

‍No Refunds for Unused Tokens: We do not offer refunds or credits for unused tokens or partial subscription periods.

‍Free Tier: Users on the free version of the app may receive a limited number of tokens when they first install the app, which are subject to the same expiration and usage limitations.

Droodle reserves the right to adjust token pricing, limits, or features associated with subscriptions at any time. Changes will not affect your current billing cycle but may apply to future renewals.

2.7 Intellectual Property

The Droodle app and its code, features, characters, and designs are the property of Kindrix Pty Ltd. Users retain rights to their original drawings but grant Droodle a non-exclusive, royalty-free license to process those drawings for the purpose of generating AI-enhanced images.

2.8 Disclaimers and Limitations

The app and its features are provided “as is,” without warranties of any kind. We do not guarantee that generated images will always function or display as expected. To the fullest extent allowed by law, Droodle disclaims liability for any direct or indirect damages resulting from the use of the app.

3.1 Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted with a new “Effective Date.” Continued use of the website or app indicates your acceptance of any changes.
